Wowza!
Timeshare Facts has put a spotlight on hundreds of timeshare horror stories.
These personal experiences come from the thousands who have filed lawsuits, or complaints with their state attorney general, or complaints with the Better Business Bureau.
But after reading this court decision involving Bluegreen Vacations, we are gob-smacked to find that what we have shared is just the tip of the iceberg!
“In this trial, the Court has learned that tens of thousands of timeshare owners have been victimized twice: first by the timeshare industry, which used false and misleading tactics to induce the owners to purchase their timeshares – often financed with high-interest mortgages…”
TENS of THOUSANDS!!
“Many of the timeshare owners testified that Bluegreen lied to them, made misrepresentations to them during the sales process, pressured them into purchasing and/or upgrading, and otherwise defrauded them.”
And then the Court summarizes ALL of the complaints against Bluegreen Vacations:
1) False statements that an owner could rent out their timeshares to earn extra money.
2) False statements that an owner was being offered an exclusive deal that was only available for that day.
3) Statements that the timeshare ownership interest would increase in value and have great resale value.
4) Misrepresentations regarding the financial significance of the maintenance fees.
5) Misrepresentations from the Bluegreen sales representatives regarding the points increment and its significance.
6) Misrepresentations regarding the outside exchange program.
7) Sales representatives coerced owners into applying for Bluegreen-branded credit cards.
8) False statements that if an owner upgraded their timeshare, they would get greater priority when booking, when in fact they did not.
9) False statements that the Bluegreen sales representative would act as the owner’s personal assistant and be available to them after the sale.
10) Failure on the part of the Bluegreen sales representative to disclose the correct interest rate on the loan.
11) Failure on the part of the Bluegreen sales representative to disclose the owner’s right to rescind the timeshare contract.
Whew! That is, well… A LOT.
But just like the iceberg… there is yet another layer to Bluegreen’s deception hiding beneath the surface.
Bluegreen Vacations tried to make the case that every single one of these owners’ statements regarding their unconscionable treatment at the hands of Bluegreen was false and should not be accepted by the Court.
Thankfully, the Court steered clear of that false logic.
“As the Court put it during the trial, it cannot be true that “these tens of thousands or hundreds of thousands of people that are going to these timeshare exit companies”—people who are “so dissatisfied with [their timeshares] that they’re willing to pay thousands of dollars to get out”—are “just all wrong.’”
Now it’s HUNDREDS of THOUSANDS??!!
“This [argument] is simply not plausible.”
“But for Bluegreen’s wrongful conduct, owners would not have sought…to unburden themselves from a lifetime of limitless and ever-increasing maintenance fees and years of high-interest loan payments, totaling tens of thousands of dollars, in exchange for illusory timeshare accommodations.”
And there it is. The Court called Bluegreen on its twelfth lie.
Maybe Bluegreen president and CEO Alan Levan has forgotten the importance of listening to its customers. As the court said, hundreds of thousands of owners can’t be wrong. Let’s send him a reminder by emailing him at alan.levan@bluegreenvacations.com.
